The Qualified Valuers behind your certificate

Unit Entitlement Valuations Pty Limited has focused on strata and community title since 1984 — and campaigned for the fairer unit entitlement rules that apply today.

Under the old rules, a developer could allocate unit entitlements however they liked — for example, giving a penthouse they kept for themselves a low number, so it carried less than its fair share of the scheme’s levies.

Unfair allocations like these led to a significant number of Tribunal applications to have them set aside, at real financial and social cost to strata communities. That is why Wal Dobrow, alongside the Australian Property Institute, pushed for unit entitlements to be assessed fairly on market value by Qualified Valuers.

The outcome: since the 2016 reforms, a Qualified Valuer must determine the unit entitlements for new strata plans on a market value basis.

Our experience

Strata specialists for more than 40 years

We know the strata legislation inside out, having specialised in strata and community title valuations since 1984. Our clients range from the largest developers in NSW to smaller strata developers.

Our long-standing relationships with surveyors and strata certifiers also help clients find the right people, so survey work is finished on time and certification runs smoothly.

Wal Dobrow wrote the Common Property Memorandum (AG520000), which clarifies whether the owners corporation or the lot owner is responsible for repairing, maintaining, renewing or replacing each item, service or area in a strata scheme. Owners corporations can adopt it in whole or in part, and its principles have been adopted into the strata legislation. It was written with two aims: harmonious living in strata, and less civil litigation.

In short, strata is what we do.

The certificates and reports we prepare

Each one is prepared and signed by a Qualified Valuer with specialist strata experience.

01

Valuer’s Certificates for New Strata & Community Plans

Getting the schedule right the first time

We prepare the Valuer’s Certificate and Schedule of Unit Entitlement required under the Strata Schemes Development Act 2015 and the Strata Schemes Development Regulation 2016, assessed on a market value basis.

Plans that include a development lot are where many valuers get it wrong: the legislation sets particular requirements for development lots that change the valuation approach entirely. This is our home ground — so you avoid the cost and lodgement delays of dealing with a novice.

02

Certificates for Strata Plans of Subdivision

When an existing scheme is subdivided again

A strata plan of subdivision needs its unit entitlements valued afresh, and the legislation treats each type of subdivision differently.

The method changes significantly depending on whether the subdivision includes common property, involves a development lot, or involves no common property at all. We have prepared schedules on each of these bases and provide the full range of Valuer’s Certificates in line with Land Registry Services requirements.

03

Unit Entitlement Re-allocation Reports

Challenging unreasonable unit entitlements at NCAT

Since 30 November 2016, section 236 of the Strata Schemes Management Act 2015 (which replaced section 183 of the 1996 Act) allows an application to the NSW Civil and Administrative Tribunal to re-allocate existing unit entitlements. Applicants can include an owner, the owners corporation, a local council or other public authority that levies rates or charges based on land value, and a lessor in a leasehold scheme.

Our two-stage approach keeps costs in check. In Stage 1 we assess whether the existing entitlements are unreasonable and recommend whether to proceed. In Stage 2, if you decide to go ahead, we prepare an Expert Report in line with the Tribunal’s Code of Conduct. A poorly drafted report can be set aside, so experience matters: we have spent the past decade training expert witnesses to present evidence in courts and tribunals.
